I think it ought to be a blanket law.  If you sue somebody and loose, you should have to bear the costs for all litigation and expenses on both sides.  Innocents are too often saddled with debt resulting from defending themselves for having done nothing.  This will make people think twice about taking the bait from ambulance chasing lawyers.
