Drunk gambler suing Vegas casino

So what do you guys think about that guy who is suing the casino for his $500k loss incurred while gambling drunk? He took out 4 lines of credit totally $500k while playing and lost it. Claims casino continued serving him alcohol and issuing credit lines after what the customer estimated to be 20 drinks (time span was not stated).


Does he have a leg to stand on legally?


-Casino didn't force the man to drink or continue gambling.
-Customer obviously didnt appear inebriated or cocktail servers and cashiers would have flagged him.
-Had he won, he wouldn't have returned the winnings.

I don't totally blame the guy. It seems that the concept of personal responsibility
is dwindling fast. I believe you should take full responsibility for your behavior, sober
or intoxicated. Unfortunately courts disagree with this and most states (43) hold
vendors liable under certain circumstances if patrons were served despite being
“visibly under the influence of alcoholic beverages.”

Sooooo..what are we saying? It was the casinos fault the guy placed the wrong bets and lost?? Or that he didnt "seem" as intoxicated as he actually was? Do we install breathalyzers at the Cashier Cage and have mobile units for each cocktail server??

If that is so, would I claim McDonalds to be in the wrong if I had a heart attack after eating a Dbl Qtr Pounder and Fries? Why??? Because they didnt test my cholesterol before selling it to me? Or my family suing Avis car rental for renting me a car after I drove head on into someone and killed myself or others?? How about suing a bar for child support after a drunken one night stand that results in a pregnancy?

The list goes on and on...

it comes down to Personal Responsibility.....I know, seems to be a term some, well, MANY nowadays, are unfamiliar with. The Fact that personal responsibility is dwindling is not a burden to be taken on (financially) by anyone BUT the "person" themself.

I'm saying this guy shouldn't be suing the casino, and I'm also saying that we shouldn't
have double standards. If you go to a bar, get drunk, and end up killing someone
no one but you should be responsible. The establishment should be absolved of all responsibility,
as in this case.


Given that 43 states have laws on the book saying bars should have some responsibility,
I'm approaching this with caution as I must be in the minority with my thought process.

There are various legal statutes that cover off various aspects of personal liability.......
There are landmark cases where a severely intoxicated person was escorted from a bar (cause he couldn't walk) he subsequently got into their car and drove into someone/something. In this case the people at the bar were charged for homosidal negligence as they should have arranged for safe transport. In another case a woman was drunk was escorted out, she subsequently was "assisted" into a back alley and sexually assaulted. Again the people at the bar were found to be at fault for not providing safe transport.
There is also a various famous case where a Kansas man donated his sperm to a pair of lesbians, had signed a bunch of  legal stuff indicating he was not in anyway the father. The couple split, he was then found by the courts legally responsible for chid care and post secondary education.

If one is borrowing money over xx dollars at a casino there should be an intoxitation test that must be administered. This would protect the casino as well as the patron. In this case the guy borrowed money from the casino which he lost to the very same casino... the casino would have been better off settling for 1/2 what was owed and keeping it out of the papers.
